Det kommer fram en del interessant informasjon i rettssakene som Bates er involvert i. Den pågående saken mellom Bates og Melvyn Levi drar f.eks. opp en del bakgrunnsinfo om situasjonen i klubben før Bates tok over.

Den tidligere Leedsdirektøren David Richmond kommer med denne vurderingen av situasjonen dengang han og Levi + Krasner ('The Yorkshire Consortium') tok over klubben i 2004:

"The chemistry of the Consortium, it was clear, wasn't going to be very good. We had taken on something which was financially too big. It was all wrong and time proved it was all wrong."

However Mr Richmond said that, had the Consortium not come in for the stricken club, it would have been liquidated and would not be in existence today.

"There is no doubt whatsoever that if we hadn't bought that football club, there would be no Leeds United," he said.

Ser at Levi spiller antisemittisme-kortet sitt mot Bates.
Det er akkurat som å kalle noen for rasist fordi de ikke liker en enkelt farget person.

The libel case brought by businessman Melvin Levi against Leeds United chairman Ken Bates has come to an unexpected halt due to an illness in one of the lawyer's families.
Day 6 of the case at London's High Court was postponed just after 10.30am on Tuesday with all parties told to return at the same time on Wednesday.

Judge Mr Justice Gray has already heard from barrister Simon Myerson QC, representing Mr Levi.

He alleged defamatory comments were made about his client in a number of Leeds United programmes and a letter Mr Bates sent to fans, all during 2006 and 2007, and that Mr Levi had been 'persecuted'.

In an October 17 2006 article it was alleged Mr Bates had wrongly given the impression that Mr Levi was "a shyster trying to blackmail Leeds United into paying him money to buy him off for not honouring his obligation."

The comments were made in the wake of Mr Bates's takeover of the club and his subsequent falling out with Mr Levi, a director of the previous regime.

Mr Myerson said that Mr Levi, 66, had been "seriously injured in his reputation and had suffered embarrassment and upset" by what Mr Bates had said in his programme notes.

But Mr Bates has vigorously denied any wrong-doing. His lawyers have counter-alleged that Mr Levi threatened to have Mr Bates killed.

It was alleged Mr Levi "made the shocking and deeply disturbing comment that people can get shot and that he, Mr Levi, was owed money and he would have no problem going to prison". The United chairman, now 77, may now have to wait until Wednesday to take the stand.

Just on YR that the club wants to issue Levi some 'papers', the club have made a request for fans to contact the club if they know or have seen Levi as he has gone awol.

@APOPEY: Just been told ex director Melvyn Levi's wife's High Court appeal for harassment by Ken Bates, Leeds Utd & Yorkshire Radio has been upheld.

@APOPEY: #lufc Ken Bates was ordered to pay Mr Levi £10k in the original case http://t.co/Zj5GBN3RY2 but his wife's claim failed.

@APOPEY: No further details known about Mrs Levi's successful appeal until a written judgement is handed down.

Leeds United chairman Ken Bates has been ordered to pay £10,000 to a former director who sued him for harassment.

Former club director Melvyn Levi claimed he suffered stress after announcements on the club radio station allegedly likened him to "a fugitive".

He also claimed comments made by Mr Bates in a match day programme amounted to speculation over his marriage.

Mr Levi later said the Football League should investigate whether Mr Bates was a suitable person to run a club.

Mr Bates cannot discuss Mr Levi's private life in public for two years, Leeds County Court ordered.

A similar claim against Mr Bates by Mr Levi's wife, Carole, failed.

Injunction granted
The judge said the Leeds chairman was allowed to mention the on-going commercial dispute between the two, known as the "Jersey proceedings", as well as other non-private matters.

Explaining why he was granting the injunction, the judge said: "I cannot think of a better reason than the delving into Mr Levi's private life in what is a commercial dispute between Mr Levi and Mr Bates which I hope will be resolved by someone else on another day."

The allegations centred around articles in a matchday programme and a broadcast on the club's radio station, Yorkshire Radio.

The court heard from Mr Bates's lawyer, Hiren Mistry, about the club's attempt to serve a writ against Mr Levi in December 2010.

The club was pursuing legal action against Mr Levi for £190,400 Mr Bates claims he and another party owed the club.

The judge heard that legal papers could have been served on Mr Levi on 22 December but this was not done because Mr Bates was going to use the Yorkshire Radio station to mention Mr Levi on a daily basis.

'Happy conclusion'
The court previously heard that radio announcements asking for information on Mr Levi's whereabouts during a Leeds match on Boxing Day in 2010 likened him to "a fugitive".

Mr Bates was accused of using the club's programme to pursue a personal vendetta and make the lives of Mr and Mrs Levi "a misery".

In 2009 Mr Levi successfully sued Mr Bates for libel over articles written in the programme and the Leeds chairman was ordered to pay £50,000 damages plus costs to Mr Levi.

On Thursday, Mr Bates, Leeds United and Yorkshire Radio have been ordered to pay the damages, their own legal costs and 30% of Mr Levis' legal costs.

Speaking after the judgment, Mr Levi said he estimated that Mr Bates, Leeds United or both had spent close to £4m fighting legal battles against him.

He said: "I'm just pleased to say that my wife and myself are happy that the matter has come to a conclusion in our favour."

The Football League said it would not be issuing any comment on the remarks made by Mr Levi about Ken Bates.

Mr Bates and Leeds United Football Club have been unavailable for comment.

The wife of ex-Leeds United director Melvyn Levi has had a claim for harassment against former club chairman Ken Bates upheld on appeal.

Carole Levi’s case - dismissed during a county court hearing in 2012 - was upheld by three judges at the Court of Appeal in London on Wednesday.

Her claim against Mr Bates related to comments published in Leeds’ matchday programme during the 83-year-old’s time as chairman and to broadcasts made on the now defunct Yorkshire Radio.

During the original court case, Mr and Mrs Levi said they had suffered stress following a series of announcements on Yorkshire Radio which Mr Levi claimed likened him to “a fugitive”.

The announcements, broadcast on and around Boxing Day in 2010, asked for information about Mr Levi whereabouts at a time when Mr Bates was trying to serve a writ on him.

Yorkshire Radio was founded by Mr Bates in 2006 and held exclusive Leeds United matchday commentary rights in 2010. The station closed in 2013.

Mr and Mrs Levi also argued that comments made by Mr Bates in his programme column amounted to speculation about the state of their marriage.

Mr Levi won his case in 2012 and was awarded £10,000 in damages by Leeds County Court. Mrs Levi’s case failed at that hearing but was upheld on appeal this week.

The Court of Appeal will publish a full written verdict at a later date and a ruling on damages owed to Mrs Levi and the award of costs is still to be made.

Mr Levi - a Leeds director between 2004 and 2005 - told the YEP that he was now considering bringing a similar claim against Shaun Harvey, the current Football League chief executive and United’s CEO at the time of the incidents leading to the harassment case between Mr Bates and the Levis.

Mr Levi said: “I’ll be going into discussions with my lawyers to decide whether there is any merit in pursuing Shaun Harvey.”

FORMER Leeds United FC chairman Ken Bates - already ordered to pay damages to an ex-club director who sued him for harassment - must now also pay the ex-director’s wife, appeal judges have ruled.

Melvyn Levi was awarded £10,000 at Leeds County Court after bringing a claim against Bates and United that he had he suffered stress through a campaign of vilification, including announcements on the club radio station that allegedly likened him to “a fugitive”.

It is plainly forseeable that, if any significant number of supporters of the club responded to Mr Bates’ incitement, they would cause Mrs Levy alarm and distress by attending or telephoning her home.

He also claimed comments made by Mr Bates in a match day programme amounted to speculation over his marriage.

The county court judge allowed Mr Levi’s claim but rejected a similar one brought by his wife, Carole, on the grounds that Mr Bates’ conduct was not aimed at her.

She appealed and today won a ground-breaking judgment that she was entitled to £6,000 damages even though she was not the actual target of the harassment.

Court of Appeal judges Lord Justice Longmore, Lord Justice Ryder and Lord Justice Briggs unanimously agreed she should receive an award.

Lord Justice Briggs said the case raised the important question whether a person harmed, or who anticipated harm, from harassment aimed at someone else was entitled to compensation under the Protection from Harassment Act 1997.

The judge ruled that the right to bring a harassment claim “extends beyond the targeted individual”, although only to those “forseeably, and directly, harmed by the course of targeted conduct”.


The judge said Mrs Levi had no right to claim for her “understandable sympathetic distress at Mr Bates’ campaign of vilification against her husband”.

But two articles in match programmes in 2007 constituted harassment of Mrs Levi “not simply because they defamed her husband but because they invited thousands of club supporters to intervene in a hostile manner, at her home, about a business dispute between her husband and Mr Bates”.

The judge said: “It is plainly forseeable that, if any significant number of supporters of the club responded to Mr Bates’ incitement, they would cause Mrs Levy alarm and distress by attending or telephoning her home.”

The judge said it was equally forseeable that “the mere publication of that incitement in the club’s match programmes would, once it came to Mrs Levi’s attention, cause her alarm and distress by an apprehension that this is what would shortly occur, even if, in the event, no supporters took up the cudgels on Mr Bates’ behalf.”


Anyone living in the family home could claim to be a victim of harassment “provided perhaps that they were old enough to pick up the telephone or answer the door-bell”.

Lord Justice Ryder agreed that Mrs Levi was entitled to damages, saying: “She was a forseeable victim. She was fortunate that the supporters had more sense or compassion than the perpetrator (Mr Bates).”

Lord Justice Longmore also agreed and said he could see no reason “why it should only be that (targeted) individual who can sue if the defendant knows or ought to know that his conduct will amount to harassment of another individual”.
