Q: Who must pass the "fit and proper person test"?

A: Under rules established by the Premier League, Football League and by the Football Association for the Conference, anybody who takes over as a director of a football club, or the owner of more than 30% of a club's shares, must pass the test.

Cellino's second attempt at Leeds United takeover 'close'
Agreement 'close' for Leeds United take over

Prospective Leeds owner Massimo Cellino is close to reaching an agreement with a rival consortium for shared ownership of the club, it has emerged.

Cellino is waiting to learn the outcome of his appeal against the Football League's decision to block his £25million takeover.

But surprisingly, the Italian has opted to join forces with Together Leeds, a Yorkshire-based group headed by former Manchester United International director Mike Farnan.

A judge in London has still to decide whether to uphold the League's decision to disqualify Cellino from becoming club owner after the businessman was convicted of tax evasion in Sardinia.

Cellino's company, Eleonora Sport, and current Leeds owner Gulf Finance House Capital exchanged contracts on February 7 on a deal that would see the Cagliari owner buy 75 per cent of the club's shares.

Together Leeds, which includes former Leeds director Adam Pearson, Welcome to Yorkshire chief executive Gary Verity, Red Strike marketing executive Frank Devoy and another unnamed member, had a bid to buy the club turned down by GFH Capital in November.

GFH Capital has since refused to engage with Together Leeds, but the Farnan-led group have not gone away and this week moved to work alongside Cellino in a bid to prevent the club from sliding into administration.

It is understood that Cellino's share purchase agreement with GFH Capital gives him and his company, Eleonora Sport, the right to decide who to sell his 75 per cent stake to if his own takeover bid fails.

Together Leeds is hoping to use that clause as a way in to Elland Road if Cellino's recent tax conviction for failing to pay import tax on a yacht contravenes the Football League's owners and directors test

Intervjuet av Cellino på SSN:

:)

THE power to block corrupt or untrustworthy people taking over clubs will be given to the Football Association rather than the leagues under a new private member’s bill presented to the House of Commons today.

Damian Collins, an MP who sits on Parliament’s culture, media and sport committee, has presented a bill which says the FA should have the power to block ownership rather than the Premier League and Football League.

The issue of the owners’ and directors’ test is in the spotlight with Italian businessman Massimo Cellino having appealed against a decision by the Football League to disqualify him from owning Leeds due to a conviction for a tax offence last month.

There has also been controversy over Carson Yeung, who last month was given a six-year prison sentence in Hong Kong for money-laundering, in that he had been convicted of two other criminal offences - in 2004 and 2010 - in the past decade yet was permitted by the Premier League to take over Birmingham in 2009 and remain chairman by the Football League in 2010.

Hvorfor stemmer aldri tidsperspektivet?
Imminent, by the end of today, by tomorrow, end of the week.

Can anybody please enlighten me on the role of the Football Leagues "Fit and Proper Persons Test" and what does it serve. Is it supposed to protect individual clubs from potential owners who do not have the interest of the club at heart, or is it designed to create a level playing field that prevents clubs such as Leeds with a rich history returning to their previous status of the "Champions of Europe". Whatever the function, it has clearly failed. If it is to protect clubs, then the test should be not only be conducted at the time of purchase but throughout the reign of an owner. Analogous to this idea is the government enforcing an MOT on a new car and never thereafter. Owners should be subject to the test at any time or not at all. Would Patel and Haigh et al pass the fit proper test, at the moment, would Ridsdale have passed it in his dark days at Leeds, would Bates have passed if it had been in place when he manipulated the creditor position at Leeds so that he had voting rights. I doubt any of them would meet a test that could unfold their true intent towards Leeds and the fans. The ¿Fit and Proper Test ¿has been put in place as instrument by the football league to fulfil its obligation of a duty of care to the game. They apply when they want and dismiss it when they want. A true and equitable mechanism would be to remove ownership of a club and entrust it to legal entity that truly represented the fans should the club face be facing administration and or liquidation. Then we might get true accountability. Under such a scheme the ground would be owned by the trust under whose constitution could never be sold to meet short term debts. If there was a will to protect football this could form an approach.
